Is your organization ready for the Whistleblower Protection Act?

Efficient programs for reporting of breaches are not important only from the legal and ethical standpoint, they also help organizations become stronger than their competition.

So far, protection for whistleblowers in Slovenia has been fragmented among several different Acts and Regulations. On 27 January 2023 the Act on the Protection of Whistleblowers was adopted, which transposes the Directive (EU) 2019/1937 on the protection of whistleblowers into Slovenian legislation. The Act stipulates that organizations employing 250 or more employees will have 90 days after the Act will enter into force to establish internal reporting channels for reporting breaches. Organizations with more than 50 and less than 249 employees will have a transition period until December 17, 2023.

Organizations will have to: 

  • Establish channels for receiving the reports which are designed and operated in a secure manner that ensures the confidentiality of the identity of the reporting person and prevents access to reporting records to non-authorized staff members.
  • Establish appropriate system that enables receiving and handling reporting breaches and that is designed in a manner that ensures the completeness and archiving of related documentation. The system shall prevent access to non-authorized staff members and ensure archiving and deletion of data after the statutory deadline.
  • Designate a person who will be in charge of receiving reports, who will maintain communication with the reporting person, where necessary, ask for further information, and provide feedback to that reporting person.
  • Adopt an internal act that will define procedures for receiving, handling, and following up on reports.
